This privacy policy applies to the data we collect from and about Buyiral’s Merchants/Store owners, Buyers, Partners, Site Visitors, or anyone contacting Buyiral Support.

Buyiral is thoroughly committed to protecting the privacy of our site visitors and customers. We fully appreciate and respect the importance of privacy on the Internet. We respect each visitor's and customer's right to personal privacy. To this end, we collect and use information throughout our website only as disclosed in this Privacy Policy.

This Privacy Policy will help you understand how we collect, use, and share your personal information. If we change our privacy practices, we may update this privacy policy. If any changes are significant, we will let you know (for example, through the Buyiral admin or by email).

2.0 Our values

At Buyiral, we understand and value the confidentiality and privacy of our users’ information. We would never sell, steal, misuse, or traffick your data, nor use same for any illegitimate, prohibited, or suspicious activities.

For the avoidance of doubt, Buyiral upholds the values that:

1. You remain the owner of all your information.

We carefully analyze what types of information we need to provide our services, and we try to limit the information we collect to only what we really need. Where possible, we delete or anonymize this information when we no longer need it. When building and improving our products, our engineers work closely with our privacy and security teams to build with privacy in mind. In all of this work, our guiding principle is that your information belongs to you, and we aim only to use your information to your benefit.

2. Your information is protected from others.

If a third party requests your personal information, we will refuse to share it unless you permit us or we are legally required. When we are legally required to share your personal information, we will tell you in advance unless we are legally forbidden.

3. We help merchants and partners meet their privacy obligations.

Many of the merchants and partners using Buyiral do not have the benefit of a dedicated privacy team, and it is important to us to help them meet their privacy obligations. To do this, we try to build our products and services so they can easily be used in a privacy-friendly way. We also provide detailed FAQs, documentation, and whitepapers covering the most important privacy topics and respond to privacy-related questions we receive.

3.0 What type of information do we collect?

When you access or use our Services, we automatically collect information about you, including:

  • Log Information: We collect log information about your use of the Services, including your browser type, app version, access times, pages viewed, your IP address, and the page you visited before navigating to our Services.
  • Location Information: We obtain the location information you provide in your profile or your IP address. With your consent, we may also determine location by using other data from your devices, such as precise location information from GPS or information about wireless networks or cell towers near your mobile device. We use and store information about your location to provide features and to improve and customize the Services.
  • Device Information: We collect information about the computer or mobile device you use to access our Services, including the hardware model, operating system and version, unique device identifiers, and mobile network information.

We collect personally identifiable information (including but not limited to email address, name, phone number, physical address, location, photo, banking details (when you make purchases), online identifiers, etc.) from you when you set up an account with Buyiral.

We also collect information about your store, including its name, URL, and description. You may also choose to provide information about social network accounts that you want to connect with your store.

We may collect additional information when you participate in any interactive features of the Services, communicate with us via third-party social media sites, request customer support, or otherwise communicate with us.

Information and personal data are as freely provided by you to us using any technology at the material time.

4.0 Why we collect and process your information

We generally process your information when we need to do so to provide and improve our Services to you, provide an optimized experience for our users and Site Visitors, and fulfill a contractual obligation (for example, to process your subscription payments to use the Buyiral platform), or where we or someone we work with needs to use your personal information for a reason related to their business (for example, to provide you with a service). These reasons are referred to as “legitimate interests.” These “legitimate interests” include:

One way we can help merchants using Buyiral is by using techniques like “machine learning” to help us improve our services. When we use machine learning, we either:

i.                 Still have a human being involved in the process (and so are not fully automated); or

ii.               Use machine learning in ways that don’t have significant privacy implications.

We may process your personal information where you have provided your consent. In particular, where we cannot rely on an alternative legal basis for processing where your data is sourced, and it already comes with consent, or where we are required by law to ask for your consent in the context of some of our sales and marketing activities. At any time, you have the right to withdraw your consent by changing your communication choices, opting out of our communications, or contacting us.

5.0 Governing Principles of Data Processing

a. Your personal data on Buyiral shall be collected and processed in accordance with legitimate and lawful purpose consented to by you herein, provided that further processing may be done only for archiving, scientific research, historical research, or statistical purposes for public interest in line with extant regulations and laws.

b. Personal data shall be adequate, accurate, and without prejudice to the dignity of the human person.

c. Personal data shall be stored only for the period within which it is reasonably needed and shall be secured against all foreseeable hazards and breaches such as theft, cyberattack, viral attack, dissemination, manipulations of any kind, damage by rain, fire, or exposure to other natural elements.

d. Our data collection shall depict that we owe a duty of care to you.

e. We shall be accountable in line with extant laws and regulations.

6.0 Personal Data Retention Period

We only keep your personal information for as long as necessary for the purposes set out in this Privacy Policy unless a more extended retention period is required or permitted by law (such as tax, accounting, or other legal requirements.)

Upon request for account closure, your account will be closed, but this closure will not involve the deletion of historical records of the account for the reasons already stated. However, except as may be required by law or law enforcement agents and/or regulators, further processing of the personal information related to the account will cease from the time of closure.

We also retain log files for internal analysis purposes. These log files are generally retained for a brief period, except in cases where they are used for site safety and security, to improve site functionality, or we are legally obligated to retain them for more extended periods.

We use personal information to provide the services you request. To the extent we use your personal information to market to you, we will allow you to opt-out of such uses. We use your personal information to:

To continually improve our product and service offerings, we collect and analyse demographic and profile data about our users' activity on our website. We identify and use your IP address to help diagnose problems with our server and to administer our website. Your IP address is also used to help identify you and to gather broad demographic information.

We will occasionally ask you to complete optional online surveys. These surveys may ask you for contact information and demographic information (like location, local government area, age, or income level). We use this data to tailor your experience at our site, providing you with content that we think you might be interested in—and to display content according to your preferences.

8.0 Your rights over your information

We believe you should be able to access and control your personal information no matter where you live. Depending on how you use Buyiral, you may have the right to request access to, correct, amend, delete, port to another service provider, restrict, or object to certain uses of your personal information (for example, direct marketing). We will not charge you more or provide you with a different level of service if you exercise any of these rights.

If you are a merchant, partner, buyer, Buyiral employee, or other individuals with whom Buyiral has a direct relationship, please submit your data subject request through our online portal. Please note that if you send us a request relating to your personal information, we have to ensure that it is you before we respond. To do so, we may use a third party to collect and verify identification documents.

Finally, where we rely on consent, you can withdraw your consent to our processing of your information using specific features that enable you to withdraw consent, like an email unsubscribe link or your account privacy preferences.

9.0 How we share your personal data

We may share personal information with our other corporate entities and affiliates to: 

  • help detect and prevent identity theft, fraud, and other potentially illegal acts;
  • correlate related or multiple accounts to prevent abuse of our services; and
  • to facilitate joint or co-branded services that you request where such services are provided by more than one corporate entity.

Those entities and affiliates may not market to you as a result of such sharing unless you explicitly opt in.

We may also share your info with third-party advertising companies who may use information (not including your name, address, email address, or telephone number) about your visits to this and other websites to provide advertisements about goods and services of interest to you.

10.0 How we protect your information

Our teams work tirelessly to protect your information and ensure our platform's security and integrity. We also have independent auditors assess the security of our data storage and systems that process financial information. Our site has stringent security measures put in place to protect against the loss, misuse, and alteration of the information under our control. However, we all know that no method of transmission over the Internet or electronic storage method can be 100% secure. This means we cannot guarantee the absolute security of your personal information.

Whenever you change or access your account information, we offer the use of a secure server. Once your information is in our possession, we adhere to strict security guidelines, protecting it against unauthorized access. However, please bear in mind that we cannot guarantee that the internet in itself is 100% secure, and so we cannot take responsibility for the illegal acts of hackers as long as we have taken the necessary precautions.

We use cookies and similar tracking technologies on our website and when providing our services. Our site links to other websites that may collect personally identifiable information about you. Buyiral is not responsible for the privacy practices or the content of those linked websites.

13.0 Changes and Modifications

Buyiral reserves the right to make changes and/or updates to this Privacy Policy from time to time and without prior notice to you. Such changes to this Privacy Policy are effective when posted on our web pages.

If we make changes, we will notify you by revising the date at the top of the policy, and, in some cases, we may provide you with additional notice (such as adding a statement to our homepage or sending you a notification). We encourage you to review the Privacy Policy whenever you access the Services or interact with us to stay informed about our information practices and available choices.
