Buyiral is an e-commerce platform that enables merchants to register their online presence and take their sales to the next level while providing buyers with an easy-to-use platform for making seamless purchases. While we believe in and value the free and open exchange of ideas and products as a key tenet of commerce, some activities are incompatible with Buyiral’s mission to make commerce better for everyone.
This Acceptable Use Policy (“AUP”) describes prohibited activities in connection with your use of Buyiral Services. All the terms in this AUP are incorporated into and form an integral part of the Buyiral ‘Terms of Service.’ Any breach of this AUP will be deemed a breach of the Terms of Service. You agree, undertake, and confirm that all the principles in this AUP shall strictly govern your use of Buyiral and that you agree to be bound by the terms of this AUP.
Buyiral may modify this AUP, including the list of Restricted Items, at any time by posting a revised version at xyz.com. By continuing to use the Services or accessing your Account after a modified version of the AUP has been posted, you agree to comply with the latest version of the AUP. In the event of a conflict between the AUP and the Terms, this AUP will take precedence, but only to the extent required to resolve such conflict.
1. Illegal Activities
You may use the Website and Services only for lawful purposes. You may not offer goods or services or post or upload Materials that contravene, facilitate, or promote activities that violate the laws of the Federal Republic of Nigeria.
You may not use the Website or Services or allow any third party to use the Website or Services for any purpose that is determined by Buyiral, in its discretion, to be unlawful, invasive, infringing, obscene, offensive, defamatory or fraudulent, or to engage in, promote or encourage illegal activity.
You shall not host, display, upload, modify, publish, transmit, update, or share any information that provides instructional information about illegal activities such as making or buying illegal weapons, violating someone's privacy, or providing or creating computer viruses or uploading materials that solicits gambling or any gambling activity which Buyiral, in its sole discretion, believes is or could be construed as being illegal.
2. Malicious and Deceptive Practices
You may not use the Services to transmit malware or host phishing pages. You may not perform activities, upload, or distribute Materials that harm or disrupt the operation of the Services or other infrastructure of Buyiral or others, including Buyiral’s third-party providers. You may not use the Services for deceptive commercial practices or any other illegal or deceptive activities.
3. Viruses and Other Destructive Activities
You will not use the Website or Services or allow any third party to use the Website or Services for creating or sending Internet viruses, worms or Trojan horses, corrupted files, hoaxes, or other items of a destructive or deceptive nature, or for pinging, flooding or mail bombing, or engaging in denial of service attacks.
You shall not host, display, upload, modify, publish, transmit, update or share any information that contains software viruses or any other computer code, files, or programs designed to interrupt, destroy or limit the functionality of any computer resource; or contains any Trojan horses, worms, time bombs, cancelbots, easter eggs or other computer programming routines that may damage, detrimentally interfere with, diminish the value of, surreptitiously intercept or expropriate any system, data or personal information.
4. Hacking
Hacking and related activities are prohibited. “Hacking” includes, but is not limited to, the following activities: Accessing computers, accounts, or networks, penetrating or attempting to penetrate security measures, port scans, and port scans illegally or without authorization and other activities designed to assist in hacking.
5. Spam
You will not use the Website or Services or allow any third party to use the Website or Services to generate, distribute, publish or facilitate unsolicited mass email, promotions, advertisements, commercial electronic messages, or other solicitations (“spam”).
6. Profanity
Your Materials (as defined in the Buyiral Terms of Service) may not contain any profane or otherwise inappropriate subject matter, as determined by Buyiral at its discretion.
7. Misrepresentation of Transmission Information
Forging, misrepresenting, omitting, or deleting message headers, returning mailing information, and/or Internet protocol addresses to conceal or misidentify the origin of a message is prohibited.
8. Terrorist Organizations
You may not offer goods or services or post or upload Materials that imply or promote support, funding, or membership in a terrorist organization.
9. Anonymous Proxies
Buyiral does not allow the use of anonymous proxy scripts on its servers. You will not access or copy any portion of the Website or Services through any automated viewing, downloading, or crawling systems.
10. Restricted Items
You may not offer goods or services that are or appear to be restricted items, whether under the laws of the Federation of Nigeria or Buyiral’s Terms of Service.
11. COVID-19 Related Products
You may only offer goods or services in relation to COVID-19 that comply with our Sales of COVID-19 Related Products Rules of Engagement.
12. Self-harm
You may not offer goods or services or post or upload Materials that promote self-harm.
13. Hateful Content
You may not use the Services to promote or condone hate or violence against people based on race, ethnicity, color, national origin, religion, age, gender, sexual orientation, disability, medical condition, veteran status, or other forms of discriminatory intolerance.
You may not use the Services to promote or support organizations, platforms, or people that:
(i) encourage or condone such hate; or
(ii) threaten or condone violence to further a cause.
14. Harassment, defamation, bullying, and threats
You may not offer goods or services or post or upload Materials that harass, bully, defame or threaten a specific individual or organization.
You shall not host, display, upload, modify, publish, transmit, update or share any grossly harmful information or any information that is harassing, blasphemous, defamatory, obscene, pornographic, paedophilic, libelous, invasive of another’s privacy, hateful, racially or ethnically objectionable, disparaging, relating or encouraging money laundering or gambling, or otherwise unlawful in any manner whatever; or unlawfully threatening or unlawfully harassing including but not limited to “indecent representation of women” or misleading in any way.
15. Child Exploitation and Child Pornography
You may not offer goods or services or post or upload Materials that exploit or abuse children, including but not limited to images or depictions of child abuse or sexual abuse, or that present children in a sexual manner.
The use of the Website or Services to store, post, display, transmit, sell, advertise or otherwise make available child pornography is prohibited. Buyiral is required by law to, and will, notify law enforcement agencies when it becomes aware of the presence of child pornography on, or transmitted through, the Website or Services.
16. Intellectual Property and Violations of Third Party Rights
You may not offer goods or services or post or upload Materials that infringe on the copyright or trademarks of others, may violate or encourage the violation of the intellectual property rights, rights of privacy, publicity rights, or other legal rights of any third party. Buyiral may remove or block access to Your Materials upon receipt of a proper notice of copyright infringement.
17. Personal, confidential, and protected health information
You may not post or upload any Materials that contain personally identifiable information, sensitive personal information, or confidential information, such as credit card numbers, confidential national ID numbers, or account passwords, unless you have consent from the person to whom the information belongs or who is otherwise authorized to provide such consent.
You may not use the Services to collect, store, or process any protected health information subject to any applicable health privacy regulation or any other applicable law governing the processing, use, or disclosure of protected health information in Nigeria.
18. Other Prohibited Activities
1. Engaging in any activity that, in Buyiral’s discretion, actually or potentially disrupts, interferes with, competes with, or is harmful to the Website or Services, Buyiral’s business, reputation, goodwill, customers and/or customer relations, or the ability of Buyiral customers to use the Website or Services effectively, is prohibited. Your failure to cooperate with Buyiral in correcting or preventing violations of this AUP that result from your activities constitutes a violation of the Terms.
2. You shall not host, display, upload, modify, publish, transmit, update or share any information that:
a. Provides material that exploits people in a sexual, violent, or otherwise inappropriate manner or solicits personal information from anyone;
b. Is patently offensive to the online community, such as sexually explicit content or content that promotes obscenity, pedophilia, racism, bigotry, hatred, or physical harm of any kind against any group or individual;
c. Tries to gain unauthorized access or exceeds the scope of authorized access to Buyiral’s Website or solicits passwords or personal identifying information for commercial or unlawful purposes from other users;
d. Deceives or misleads the addressee/ users about the origin of such messages or communicates any information which is grossly offensive or menacing in nature;
e. Threatens the unity, integrity, defence, security, or sovereignty of The Federal Republic of Nigeria, friendly relations with foreign states, or public order or causes incitement to the commission of any cognizable offence or prevents investigation of any offence, or is insulting any other nation.
f. That is false, inaccurate, or misleading.
3. When using Buyiral or any Buyiral Services, you agree and undertake that:
a. You shall not attempt to gain unauthorized access to any portion or feature of the Buyiral website, or any other systems or networks connected to Buyiral Website or any Buyiral server, computer, network, or to any of the services offered on or through Buyiral Website, by hacking, password “mining” or any other illegitimate means.
b. You shall not create liability for us or cause us to lose (in whole or part) the services of our ISPs or other suppliers;
c. You shall not falsely express or imply that Buyiral sponsors, endorses, or is otherwise affiliated with You or Your content.
d. You shall not probe, scan or test the vulnerability of the Buyiral website or any network connected to the Buyiral website nor breach the security or authentication measures on the Buyiral website or any network connected to the Website.
e. You shall not reverse look-up, trace, or seek to trace any information on any other user of or visitor to Buyiral Website, or any other customer of Buyiral, including any Buyiral account not owned by you, to its source, or exploit Buyiral Website or any service or information made available or offered by or through Buyiral Website, in any way where the purpose is to reveal any information, including but not limited to personal identification or information, other than your information, as provided for by Buyiral Website.
f. You will not take any action that imposes an unreasonable or disproportionately large load on the infrastructure of the Buyiral Website, Buyiral’s systems or networks, or any systems or networks connected to Buyiral.
g. You shall not pretend that you are or that you represent someone else or impersonate any other individual or entity.
h. You shall not lift (i.e., copy and paste) images of products you want to sell on Buyiral from other websites. Images used must be original, not stolen images or content posted on another site. If you violate this term, you hereby agree to indemnify Buyiral of any third party claim thereon.
i. You shall not circumvent any authentication or security systems or processes on or relating to our website.
j. You shall not violate this Agreement or encourage or assist anyone else to violate this Agreement.
Buyiral has the right, but not the obligation, to monitor or investigate any Materials and your use of the Services at any time for compliance with this AUP and the Buyiral Terms of Service or any other agreement between you and Buyiral governing your use of the Services (collectively, the “Terms”).
In addition to any remedies that Buyiral may have at law or in equity, if Buyiral reasonably determines that You have violated or are likely to violate the foregoing prohibitions, Buyiral may take any action it reasonably deems necessary to cure or prevent the violation, including, without limitation, the immediate removal of materials that violate the foregoing prohibitions from the Site.
Our determination of whether a violation of this AUP has occurred will be final and binding, and any action taken with respect to enforcing this AUP, including taking no action at all, will be at our sole discretion.
Buyiral may cooperate with any law enforcement authorities, court order, subpoena, or third party requesting or directing Buyiral to disclose the identity of anyone posting such materials as prohibited in this AUP.
